ABOUT THIS SEMINAR

August 15, 2024, Immigration Practitioner Centre Continuing Professional Development Seminar is addressing updates related to Criminal Inadmissibility, Family Class Portal, Special Measure Programs, and Immigration Appeal Division Practice Tips.

A cross-section of immigration topics that have been undergoing changes or revisions, of late includes Criminal Inadmissibility and Consequences of Temporary and Permanent applications and potential solutions; Updates to the Family Class Processing Portal related to Parents/Grandparents and In Canada and Abroad Spousal/Common Law cases and Open Work permits; Updates and Ministerial Announcements related to Special Measure Programs; and Practical Tips for representing clients before the Immigration Appeal Division when dealing with refused Family Class Applications and the loss of Permanent Residency status.

The four topics identified for this seminar are interrelated given that we have seen Criminal Inadmissibility have dire consequences on a client’s ability to gain temporary or permanent status and potentially lose one’s status and appeal rights.

We have seen recent Minister’s announcements about Family Class Processing and the Use of the Family Class Portal being limited to 34,500 Expressions of Interest that were accepted in October 2020 with no new sponsors being accepted into the sponsorship pool.

The Minister has announced several new Special Measure Programs and changes to proposed targets for these programs.

Lastly, we have seen hints of changes to the IRB system regarding speeding up deportations to the potential of a potential amnesty related to foreign nationals in Canada without legal status being granted a possible pathway to permanent residency and citizenship.

MEET THE SPEAKERS

Gabriel Chand

LAWYER

Criminality, Inadmissibility, and Consequences 

Gabriel Chand founded Chand & Company Law Corporation in 2007. He has appeared before all of the divisions of the Immigration and Refugee Board, the Federal Court of Canada, the British Columbia Provincial Court, the British Columbia Supreme Court, and the British Columbia Court of Appeal.  Gabriel has also appeared as lead counsel in proceedings before the Supreme Court of Canada. 

Gabriel was an instructor at the University of British Columbia for over 20 years, and he served as a public representative on the Discipline Committee of the Canadian Society of Immigration Consultants (CSIS), the Immigration Consultants of Canada Regulatory Committee (ICCRC), and the College of Immigration and Citizenship Consultants (CICC) for over 15 years.   

Alexandra Callinan

Portal Update for Family Class Processing 

Alexandra Callinan has been a lawyer since 2019. Prior to attending law school, she worked at the Operations Support Centre and the Case Management Branch at the Immigration, Refugees and Citizenship (IRCC) national headquarters in Ottawa. Currently, Alexandra is an Associate at Mamann Sandaluk & Kingwell LLP, where her practice primarily focuses on corporate immigration matters. 

Alexandra's dedication to her clients, her practice, and her role as an educator are inspired by her years of experience working at the IRCC, as well as her own family's journey as immigrants and refugees coming to Canada.

Special Measure Programs 

Mahsa immigrated to Canada at the age of 16 from Iran. She holds a BA degree in Psychology and Gender, Sexuality, and Women Studies from Simon Fraser University in Burnaby, British Columbia. She also completed her Immigration Consultant Diploma in March 2020 from Ashton College in downtown Vancouver. She started her own immigration business in January 2021 after successfully passing her Entry to Practice Exam. Mahsa established “Mehrvarz Immigration” with the goal of assisting people who want to immigrate to Canada for a better life and career opportunities. Mahsa provides services in many areas of immigration, refugee, and citizenship and she has been representing clients before the Immigration and Refugee Board of Canada for the past two years. Mahsa has been a tutor/mentor for the past 10 years and she is excited to curate her passion for teaching and affinity for immigration. 

Anita Boscariol

Practical Tips on Appearing Before the IAD 

Anita is an Associate Counsel at Watson Goepel LLP. Her practice primarily focuses on Indigenous Law, with a portion dedicated to the area of Immigration Law. Having worked in the public sector for over 25 years, the last ten as Director General of Treaties and Aboriginal Government Negotiations West for the former Department of Indigenous & Northern Affairs, Anita brings a wealth of experience and perspective to her Indigenous practice. 

Anita assists and advises a variety of clients on matters related to Indigenous self-government, economic development, governance, engagement, consultation, and accommodation. She is an accomplished negotiator, consensus builder, and problem solver.
